C. Appointment scheduling/registration

[1] MYMEDI-PAL services are available only to, and may only be used by, individuals who are 18 years and older who can form legally binding contracts under applicable law. You represent and warrant that you are at least 18 years old.  Individuals under the age of 18 must at all times use MYMEDI-PAL services only in conjunction with and under the supervision of a parent or legal guardian who is at least 18 years of age. In such cases, the adult is the user and is responsible for any and all activities and transactions that involve the applicable minor on the Site.

[2] By acknowledging and agreeing to these Terms and Conditions as part of the MYMEDI-PAL intake and registration process, you acknowledge that you understand and agree that you are personally responsible for payment of all services rendered. You also understand that if you suspend or terminate any services, any fees for professional services already rendered will be immediately due and payable. You agree to pay all balances over 90 days from the original due date, as well as applicable court costs and reasonable collection and attorneys’ fees incurred in collecting any amount due, to the extent permitted by law.

[3] You will need to provide your first and last name, email address, credit card information, billing address and phone number.

[4] Any client of MYMEDI-PAL agrees and understands in providing an email that is shared by another individual accepts that using a shared email will allow the sharing and access to their personal health information and shall not hold MYMEDI-PAL liable for any information obtained in such circumstances.

[5] You must keep your account information up-to-date and accurate at all times, including a valid email address. In order to utilize the paid services on the Site, you must provide and maintain a valid payment method, such as valid credit card information, with MYMEDI-PAL's merchant services provider, Square.  For information on Square, and your payment information, please visit website link: https://squareup.com/us/en/legal/general/privacy

[6] If you are registering as a business entity, you personally guarantee that you have the authority to bind the entity to this Agreement.

[7] MYMEDI-PAL reserves the right to refuse service to anyone, for any reason or no reason, at any time and to terminate any accounts.

[8] Please see and review CANCELLATION and NO SHOW POLICY when scheduling appointments with MYMEDI-PAL.

[9] MYMEDI-PAL provides self-pay services and does not accept or bill health insurance at this time.

[10] MYMEDI-PAL offers non-clinical healthcare navigation, education, advocacy, and support services. Services may include appointment preparation, educational diagnosis navigation, health-record review and navigation consultation, caregiver support/coaching, and comprehensive care coordination. Available services, current fees, and general service descriptions are provided on the MYMEDI-PAL website or communicated to the client before purchase.

Each service is limited to the scope and deliverables identified in the applicable service description, order confirmation, invoice, or individualized written scope, when applicable. Services or work outside the purchased scope may require an additional fee, upgraded service, or separate engagement.

[11] Certain MYMEDI-PAL services are offered for a fixed fee based upon a defined scope and deliverable. Other services, including complex or ongoing care-coordination engagements, may be individually scoped and priced based upon the client's needs and the anticipated level of support.

The purchase of a fixed-price service does not entitle the client to unlimited consultation time, communications, record review, follow-up, or ongoing navigation unless expressly included in the service purchased.

[12] When a service includes a consultation or scheduled session, the duration and number of sessions included will be identified in the applicable service description, booking confirmation, or individualized scope.

Additional consultation time or additional sessions requested by the client are not automatically included and may require an additional fee or separate booking.

MYMEDI-PAL may offer a complimentary introductory or clarity call to help determine whether a MYMEDI-PAL service may fit the prospective client's navigation needs. An introductory or clarity call is not a medical consultation, does not include medical-record review, and does not establish a treating physician-patient relationship.

[13] Turnaround times vary by service and will be identified in the applicable service description or order confirmation.

Unless otherwise stated, the turnaround period begins after MYMEDI-PAL has received all information required to begin the service, including applicable payment, completed intake information, requested records, and required authorizations.

Delays in submitting requested information or records may extend the completion date.

[14] MYMEDI-PAL may offer expedited or priority processing for certain services for an additional fee and subject to availability. Priority processing changes the anticipated turnaround time only and does not expand the scope or deliverables of the underlying service.

[15] When health-record review is included in a purchased service, MYMEDI-PAL will review records for educational, organizational, advocacy, and healthcare-navigation purposes within the scope of that service.

Submission of records does not automatically mean that all submitted records will be reviewed. Records exceeding an established service allowance, records submitted after review has begun, supplemental records, or records unrelated to the purchased service may require additional fees, additional processing time, or a different service.

Health-record review does not constitute an independent diagnosis, second medical opinion, medical-necessity determination, utilization review, treatment recommendation, or evaluation of whether a healthcare professional met an applicable standard of care.

[16] Care-coordination services may involve ongoing navigation, advocacy, organization, case-management support, appointment preparation, authorized provider-office communication, record organization, and other agreed-upon navigation activities.

Because the needs of each client may differ, the specific scope, duration, deliverables, communication expectations, and fees for a comprehensive care-coordination engagement may be established in an individualized written scope, service confirmation, or addendum.

Care coordination does not include diagnosis, treatment, prescribing, medication management, medical-necessity determinations, utilization review, legal representation, or financial advice.

[17] Caregiver support/coaching services are intended to assist caregivers with healthcare organization, preparation, communication, advocacy skills, and navigation of healthcare-system processes.

Caregiver support/coaching is not medical care, mental-health therapy, crisis counseling, or treatment of either the caregiver or care recipient. When services involve another person's healthcare information or communication with that person's healthcare providers, MYMEDI-PAL may require appropriate authorization before accessing, using, or disclosing information related to that individual.

[18] A new diagnosis, newly submitted records, additional healthcare concerns, additional consultations, continued navigation after completion, or requests materially outside the originally purchased service may constitute additional work.

MYMEDI-PAL will determine whether such requests can be addressed through an additional fee, service upgrade, or separate engagement before performing additional work.

[19] Current fees are provided on the MYMEDI-PAL website or communicated before purchase and are subject to change prospectively. The fee applicable to a client is the fee associated with the service at the time of purchase unless otherwise agreed in writing.

Clients are financially responsible for all services they purchase or authorize.

[20] A fixed-deliverable service is considered completed when MYMEDI-PAL has provided the deliverable and any consultation or follow-up expressly included with that service.

Completion of one service does not create an obligation for MYMEDI-PAL to provide continuing navigation, additional record review, follow-up consultations, or ongoing support unless those services have been separately purchased or agreed upon.

[21] Scheduled consultations and sessions are subject to MYMEDI-PAL's applicable Cancellation and No-Show Policy.

No refund will be provided for services already rendered or substantially completed.

Any refund or cancellation rights applicable before work begins will be governed by the cancellation/refund terms presented with the applicable service.

[2] You hereby consent to, and waive all defenses of lack of personal jurisdiction with respect to venue and jurisdiction in the state and federal courts of North Carolina. You further agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated or representative action. If for any reason a claim is initiated in court rather than in arbitration you and MYMEDI-PAL waive any right to a jury trial.
